Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") are a legally binding agreement between you and GOMASAUCE LLC ("Company," "we," "us," or "our"), governing your access to and use of the Shiftr employee scheduling platform (the "Service"). By creating an account or using the Service, you agree to these Terms in full.

If you are using Shiftr on behalf of a business, you represent that you have the authority to bind that business to these Terms.

2. Eligibility

You must be at least 18 years of age to use the Service. By using Shiftr, you represent and warrant that you meet this requirement and that you are not prohibited from using the Service under any applicable law.

3. Account Registration

You must register for an account to use Shiftr. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your password and for all activity under your account.

4. Subscription and Payment

Shiftr offers Free, Pro, and Enterprise plans. Paid plans are billed on a monthly basis. By subscribing to a paid plan, you authorize GOMASAUCE LLC to charge your payment method on a recurring basis until you cancel.

Cancellations take effect at the end of the current billing period. No refunds are issued for partial billing periods unless required by applicable law.

We reserve the right to modify pricing with 30 days' notice. Continued use after the effective date constitutes acceptance of the new pricing.

5. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Send unsolicited communications to employees or other users
Interfere with or disrupt the integrity or performance of the Service
Attempt to gain unauthorized access to any part of the Service
Reverse engineer, decompile, or disassemble any part of the platform
Use automated tools to scrape or extract data without written permission
Upload content that violates any third-party rights or applicable law

6. Employee Data and SMS Consent

By adding employee contact information to Shiftr, you represent that you have obtained all necessary consents from those employees to receive schedule notifications and shift reminders via SMS and email. You assume full responsibility for compliance with applicable messaging laws including the TCPA and CAN-SPAM Act.

7. Intellectual Property

The Shiftr platform, including its design, code, branding, and content, is owned by GOMASAUCE LLC and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

You retain ownership of any data you input into the Service. By using Shiftr, you grant us a limited license to process your data solely to provide the Service.

8. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. GOMASAUCE LLC does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation of Liability

To the fullest extent permitted by law, GOMASAUCE LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability shall not exceed the amounts paid by you in the 12 months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account at our discretion, with or without notice, for violation of these Terms or for any other reason. Upon termination, your right to access the Service ceases immediately.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Orange County, California.

12. Changes to Terms

We may update these Terms at any time. We will provide notice of material changes via email or in-app notification. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
